Installing a drainage structure within the 50 foot trout stream buffer without first obtaining a stream buffer variance; failing to design and indicate a 50 foot trout stream buffer on the ESPCP; failing to indicate storm water monitoring on the NOI; failing to indicate accurate state waters classification on the NOI; failing to design, install and/or maintain BMPs; failing to design the ESPCP and conduct storm water monitoring as required to achieve representative turbidity sampling; failing to temporarily stabilize all disturbed areas not worked within 14 days; failing to require the Design Professional to certify the ESPCP after any changes in construction, operation, and/or maintenance which had a significant effect on BMPs with a hydraulic component; failing to amend newly added BMP changes to the ESPCP within 7 calendar days; failing to document all incidences of noncompliance; failing to submit violation summary reports with 14 days of discovery |
