Cause of Order From September 1, 2015 to September 30, 2017, the Respondent experienced numerous unpermitted discharges and outfall spills; fish kill on December 16, 2015; from September 1, 2015 to May 31, 2018, Respondent experienced numerous effluent permit limit exceedances and other narrative noncompliance; from May 2017 to May 2018, Respondent reported chronic violations of total suspended solids (TSS) and phosphorus from its R.M. Clayton WRC
Requirements of Order Pay settlement; address all comments in March 2015 letter regarding DDR; submit schedule for decommissioning of Intrenchment Creek WRC and upgrades at South River WRC within 180 days; beginning upon the Division's written concurrence of the completion schedule, submit to the Division semiannual progress reports on the decommissioning of Intrenchment Creek WRC and upgrades at South River WRC; w/in 90 days of execution of this Order, submit to the Division a summary of improved operational and control measures at the R.M. Clayton WRC to optimize phosphorus removal and achieve compliance with the phosphorus effluent permit limitations; w/in 30 days of the execution date of this Order, submit to the Division a summary of improved operational and control measures that have been implemented and will be implemented at the R.M. Clayton WRC to minimize TSS discharged and to consistently achieve compliance with the TSS effluent permit limitations

Cause of Order Total Recoverable Copper and Total Residual Chlorine violations
Requirements of Order Within 30 days, evaluate Copper and Chlorine violations and submit results to EPD; w/in 60 days, submit 2 CAPs for approval to EPD; within 24 months, have 6 consecutive months of compliance with copper; starting in 24 months, pay $250 per month for each month for copper violations or failure to comply with order
