Cause of Order Between October 4 and October 9, 2018, an unreported spill of untreated wastewater occurred; Respondent failed to notify Division of spill as required; from October 23 through October 24, 2018, a spill of 25,000 gallons of untreated wastewater occurred; on October 31, 2018, a spill of 500 gallons of untreated wastewater occurred; from November 4 through November 7, 2018, a spill of 40,000 gallons of untreated wastewater occurred
Requirements of Order Comply with all effluent limitations and requirements established by the Permit; w/in 30 days of the execution date of this Order, submit for EPD review and approval, a Corrective Action Plan (CAP) and an associated timeline that will be implemented for the Facility to assess and address the repeated unpermitted discharge of untreated wastewater, the CAP, when approved by the Division, will become a part of this Order and must be executed per the timeline for completion in the CAP

Requirements of Order Beginning June 30, 2019, the Respondent must submit quarterly calendar year progress reports documenting any and all actions taken to secure a funding source to perform maintenance including replacement of the mats at the Facility; funding must be obtained within 12 months of the execution of this Order; after securing a funding source, submit quarterly calendar year progress reports documenting actions taken to perform maintenance including replacement of the mats at the Facility; construction must be complete within 24 months of execution of this order; upon the Division's review of the Respondent's submitted Monthly Discharge Monitoring Reports, all parameters containing effluent limitation violations occurring before the resolution of this Order will be addressed through an Expedited Enforcement Compliance Order (EECO)

Cause of Order Consent Order EPD-WP-8321 is being amended for the following reasons: (1) extend the compliance schedule for formaldehyde violations that were the subject of Consent Order EPD-WP-8321, (2) resolve Formaldehyde discharge violations that occurred after execution of Consent Order EPD-WP-8321, (3) extend the stipulated settlement and payment for Fecal Coliform discharge violations incurred after November 30, 2018, (4) resolves Ammonia and Toxicity violations that occurred after execution of Consent Order EPD-WP-8558.
Requirements of Order Pay negotiated settlement amount; implement revised Corrective Action Plan approved by EPD on March 6, 2019; and pay stipulated penalty for fecal coliform discharge violations which is extended for twelve months; all other conditions of Consent Order EPD-WP-8321 remain in effect and unchanged
