Cause of Order Violations of General NPDES Permit for Storm Water Discharges Associated with Construction Activity/no Notice of Intent or Erosion, Sedimentation & Pollution Control Plan, buffer encroachment
Requirements of Order Immediately stop all land disturbing activity at site until appropriate erosion & sedimentation control measures have been established, ES&PCP has been properly prepared, NOI submitted, fees paid, and Land Disturbing Activity Permit is received by issuing authority; take all steps necessary to comply with Permit; submit approvable Buffer Restoration Plan/schedule, by design professional; included will be restoration of areas impacted by fill, mechanical land clearing, etc, to pre-existing elevations, and replanting of native species, maintaining until established; upon approval implement plan, notifying EPD for inspection; submit buffer variance application; remove and properly dispose of construction/demolition debris, submitting disposal receipts
