Cause of Order | Illegally disposing of F005 hazardous waste paint filters in the solid waste dumpster; failure to make a hazardous waste determination on spent paint filters in the paint booth by Hydrographic Line; failure to inspect areas where containers are stored; failure to label seven 55-gallon containers with the words "Hazardous Waste"; failure to keep closed a 55-gallon drum of spent solvent located in the 90 Day Storage Area beside the paint kitchen and a 5-gallon container located on Hydrographic Line 3, except when necessary to add or remove waste; failure to mark a 5-gallon satellite container located in Line 3 containing spent solvent with the words "Hazardous Waste" or with other words that identify the contents; failure to have the accumulation start date marked on five 55-gallon drums of spent solvent waste that had been moved from the 90 day Storage Area to the rear dock area to be sent-off site for disposal |
Requirements of Order | Immediately cease illegal disposal of hazardous waste; w/in 30 days of the execution date of this Consent Order, provide the Division for approval a plan to prevent the violations cited in this Consent Order from occurring in the future, upon approval by the Division the Respondent shall implement the plan; w/in 30 days of receiving the Division's approval of the plan described in Condition 3 above, the Respondent shall provide documentation to the Division that plan required in Condition 3 has been implemented, the documentation should include evidence of the proper disposal of spent paint filters |
