Cause of Order Failure to obtain a permit for treating and disposing of hazardous waste from the containment area via thermal treatment and evaporation; failure to make a waste determination for the dust coming from the dust buffer and the sludge from the evaporator as required by the Notice of Violation; failure to maintain and operate the Facility to minimize the possibility of a fire, explosion, or any unplanned release of hazardous waste or hazardous waste constituents to air, soil or surface water. The soils around the chrome stripping area are discolored and the dust from the grinding and buffing of metal items is being release from the building
Requirements of Order Respondent shall not conduct treatment or disposal of hazardous waste without a permit, any such treatment or disposal shall cease immediately; w/in 30 days the Respondent shall submit to the Division a waste determination conducted in accordance with 40 CFR 262.11 for the dust generated by the dust buffer and the sludge from the evaporator; w/in 30 days of the execution of this Consent Order, the Respondent shall submit to the Division written procedures that were implemented by the Respondent to prevent the violations cited in this Consent Order; w/in 60 days of the execution date of this Consent Order, the Respondent shall submit a Corrective Action Plan for the assessment and remediation of soil and groundwater contamination resulting from the disposal of hazardous waste and/or release of hazardous constituents at the Facility to the Division for approval
