Failed to restrict prohibited waste disposed of in the Inert Landfill; failed to restrict the unloading at the Inert Landfill; failed to maintain a fire protection stock pile at the Inert Landfill; failed to construct the inert landfill cells and have the Best Management Practices in place; stockpiled inert waste on top of the closed inert landfill and failed to conduct post closure care for the closed inert landfill and the MSWL; failed to remove the concrete washout and sections of roof; failed to operate the Facility in accordance with the Rule and Permit that states landfills shall be operated in such manner to prevent environmental, and public health hazardous |
| Requirements of Order |
w/in 120 days of execution of this Order, Respondent agrees to achieve compliance at the Facility and operate the Facility per the approved D&O plan and solid waste handling permit; obtain repair estimates and budget to have such repairs implemented on the compactor; work the the Division's Scrap Tire Program to seek possible funding and other support to improve tire handling and shipping from the Facility; w/in 120 days, ensure the concrete washout material is broken up and recycled or disposed of within the active inert landfill following completion of the cell; ensure the concrete within the abandoned truck drum is broken up and recycled or disposed of within the active inert landfill following completion of the cell; w/in 120 days of execution of this Order, the Respondent shall ensure sections of old roof and concrete drum will be scraped and recycled |
