Cause of Order Failure to make a hazardous waste determination on all waste at the facility including the parts washer solution in the drum connected to the parts washer, mineral spirits, 3 lead acid batteries, and the 2 55-gallon drums located behind the quonset building; failure to stop the release of used oil and failure to clean-up and manage properly the released used oil and other materials; failure to keep the 5 gallon containers and the approximately 500-gallon used oil storage tank closed while stored outside, except when necessary to add or remove used oil; failure to label the 500-gallon tank, five 5-gallon buckets, and the oil caddy containing used oil clearly with the words "Used Oil"
Requirements of Order W/in 60 days of the execution date of this Consent Order, provide the results of hazardous waste determinations for all wastes at the facility ; w/in 60 days of the execution date of this Consent Order, provide written procedures that were implemented by the Respondent to prevent these violations from occurring again; w/in 60 days of the execution date of this Consent Order, submit for approval a plan and schedule to clean-up and manage properly all released used oil and impacted soil, concrete and other materials at the Facility; w/in 90 days of the execution date of this Consent Order, submit to the Division documentation that the Facility is operating in compliance with plans described in Condition 3
