Cause of Order |
Treatment of hazardous waste without a permit; failure to make an accurate hazardous waste determination on solid wastes generated at the facility; waste absorbent pads, paint brushes and rollers, which contained a listed hazardous waste, were transported to solid waste management facility as non-hazardous waste; failure to maintain the and operate the facility to minimize the possibility of a non-sudden release of hazardous waste or hazardous waste constituents to the air, soil, or surface water which could threaten human health and the environment; failure to accumulate hazardous wastes at or near the point of generation; failure to close containers of hazardous waste at a SAA at all times during accumulation; failure to mark or label hazardous waste containers at a SAA with the words "Hazardous Waste" and an indication of the hazardous of the contents; failure to mark or label hazardous waste containers at a SAA with an indication of the hazards of the contents; failure to accumulate hazardous waste at a CAA in a closed container; failure to mark or label containers at a CAA with the following: the words “Hazardous Waste”, an indication of the contents, and the date upon which each period of accumulation begins; failure to mark or label hazardous waste containers stored at a CAA with an indication of the hazards of the contents; storage of hazardous waste for more than 90 days in a CAA; failure to immediately contain all releases of UW and other residue from UW; failure to close a 4 foot long box of UW lamps; failure to label or mark clearly a container of UW lamps; failure to demonstrate the length of time that UW has been accumulated from the date it becomes a waste; failure to label or mark clearly containers used to store used oil with the words “Used Oil” |
Requirements of Order |
W/in 90 days after the execution date of this Consent Order, submit a plan to ensure that the paint drying boxes are operated in a manner that prevents the emission of paint waste vapors from the box; w/in 90 days of the execution of this Consent Order, submit for approval by the Division a plan to evaluate the facility's existing waste streams to ensure that appropriate waste determinations have been made, and will be made for new streams |
