Cause of Order Between October 4 and October 9, 2018, an unreported spill of untreated wastewater occurred; Respondent failed to notify Division of spill as required; from October 23 through October 24, 2018, a spill of 25,000 gallons of untreated wastewater occurred; on October 31, 2018, a spill of 500 gallons of untreated wastewater occurred; from November 4 through November 7, 2018, a spill of 40,000 gallons of untreated wastewater occurred
Requirements of Order Comply with all effluent limitations and requirements established by the Permit; w/in 30 days of the execution date of this Order, submit for EPD review and approval, a Corrective Action Plan (CAP) and an associated timeline that will be implemented for the Facility to assess and address the repeated unpermitted discharge of untreated wastewater, the CAP, when approved by the Division, will become a part of this Order and must be executed per the timeline for completion in the CAP
