| Cause of Order |
Failed to properly monitor the Facility for coliform bacteria during the September 2014, November and December 2015 monthly compliance periods; failed to have a Certified Operator to operate the Facility since January 2015; failed to maintain required trust indenture on file with the Division since September 2016; failed to report water usage on the monthly reports to the Division; failed to monitor for Radionuclides during several quarters of 2016, 2017, 2018, and 2019; failed to collect annual Nitrates during the 2014 monitoring period at Water System Facilities 201 and 205 and the Water system failed to collect annual Nitrates during the 2017 monitoring period at Water System Facility 205, and the Water System failed to collect annual Nitrates during the 2018 monitoring period at Water System Facilities 201 and 205 during the System's recent compliance period (01/01/2018-12/31/2018); failed to comply with the public notification requirements for the Nitrate Failure to Monitor during the 2014 monitoring period as required; failed to prepare and distribute the CCR for the Facility for the 2014, 2015, 2016, and 2017 laboratory reporting years and submit a copy to the Division by July 1, 2015, July 1, 2016, July 1, 2017, and July 1, 2018; failed to submit Certification Forms for the 2014, 2015, and 2016 laboratory reporting years for the Facility; failed to provide the Division with an up-to-date acceptable Business Plan; sample at a specific number of sites within the distribution system every 6 months for Lead and Copper; failed to monitor for Lead and Copper during the 1/1/2018-6/30/2018 and 7/1/2018-12/31/2018 compliance periods |
| Requirements of Order |
Comply with the Drinking Water Act and Drinking Water Rules; within 30 days of the execution date of this Order, submit a complete Drinking Water Permit Renewal Application and provide an up-to-date Business Plan to the Division; upon execution date of this Order, immediately initiate submission of monthly water operating reports, inclusive of water usage in gallons and chlorine residuals at the Facility on the monthly operation report form to the Divisions Northeast District by the 10th day of the month following the month being reported; no later than 5 days from the execution of this Order, obtain the services of a State Certified Water Operator, that is available to maintain records, collect samples, and oversee the daily operation of the Facility; make repairs and reactivate Source #105; w/in 30 days following the execution of the Consent Order by the Division, prepare and distribute the 017 CCR that summarizes the laboratory information from 2014, 2015, 2016 and 2017 to the residents of the Facility and submit a copy of the CCR and Certification Form to the Division ; continue to distribute annual CCR to consumers and submit a copy to the Division by July 1 of each year; no later than 30 days from the execution date of this Order, complete the requirements for Public Notification required and submit proof of such to the Division for all monitoring violations incurred at the Facility; upon execution date of this Order, resume, at the Facility, all required sampling per the Drinking Water Act, Drinking Water Rules, and Drinking Water Permit; |
