| Requirements of Order |
Upon execution by the Respondent and the Director, this Order supersedes consent order EPD-SW-2789, which shall be forever terminated and of no further force or effect; respondent shall crush and remove all of the concrete at the Site by July 31, 2021; respondent shall be considered to be in compliance with the requirements of Condition 2 if the Respondent can demonstrate that the provision below applicable to the most recently concluded year is true, as determined by the Director: a) within the first year, 40% of the Crushed concrete has been removed, (b) within the second year, 100% of the Crushed concrete has been removed; if Respondent is not in compliance with Condition 2, Respondent shall remove all remaining concrete at the Site and transport it to a permitted solid waste disposal site for proper disposal by July 31, 2021; after all concrete has been removed or closure has been completed under Conditions 2 or 4, this order shall terminate; if respondent fails to complete either Condition 2 or Condition 4 by the specified deadline, pay monthly penalty |
