Cause of Order Failing to design and ensure that some BMPs were installed and/or maintained; failing to report sediment entering state waters and ensure repair of BMPs within 2 or 7 business days; failing to design ESPCP to illustrate all construction activities; failing to ensure the installation and/or maintenance of temporary stabilization for areas not worked within 7 days; failing to conduct turbidity storm water monitoring; failing to submit required storm water monitoring reports; failing to ensure all incidences of noncompliance were recorded; failing to ensure every BMP inspection was signed and certified; failing to ensure that BMP deficiencies identified in BMP inspection/certification reports; failing to amend and keep current the ESPCP; failing to ensure the installation and/or maintenance of concrete wash out pit; failing to submit a summary self-report to EPD within 14 days of discovery where BMPs were not installed and/or maintained; failing to properly document any and all known violations; failing to submit a violation summary report
Requirements of Order Bring the Site and the revised ESPCP into full 2018 Permit compliance; submit a BMP certificate letter from a certified Design Professional certifying that all BMPs at the Site have been install/maintained in accordance with ESPCP; conduct additional stormwater monitoring and reporting after every 0.5 inch or greater rain event for all disturbed areas that have not met final stabilization
